Matthew Vinciguerra focuses his practice on construction and government contracts. He has assisted clients in connection with a wide array of public and private projects, including power plants, highways, airports, hotels, school facilities, hospitals, commercial office buildings, condominium developments, retail centers and mass transit systems. Matt has successfully resolved complex construction disputes in a variety of venues, including mediation, state and federal courts, and international and domestic arbitration. Most recently, he was involved in the successful representation of the designer of a nuclear power plant in Taiwan against the government-owned Taiwan Power Company, and the successful representation of a design-build contractor for a United States embassy.
As part of his federal and state government contracts practice, Matt develops, drafts and prosecutes bid protests, and advises clients on regulatory compliance issues. He also prepare claims, complaints and motions; coordinates and manages extensive pretrial discovery; conducts witness interviews; takes and defends depositions; conducts hearings, including direct and cross examination; formulates recovery strategies and theories; and counsels clients as to all aspects of dispute avoidance and settlement, both during project performance and before and after submission of claims.
In addition to his litigation experience, Matt also works with the transactional aspects of construction law, including contract preparation, negotiation and analysis. He has prepared design and construction agreements on behalf of developers, contractors and design professionals, and works routinely with contractor/CM agreements, architect/engineer agreements and trade contracts/subcontracts, from the contract formation phase through project completion and close-out. Matt also provides counsel as to surety bonding, insurance and lien matters.
